Privacy Policy

This site is hosted by Big Commerce. Big Commerce hosts the store pages, ordering system, and order data. Big Commerce automatically collects order information but may only use this information in the aggregate. Please see the Big Commerce Privacy Policy for more information about how Big Commerce uses this information.

1. Scope and who we are

This Privacy Policy describes how Response Marketing, Inc. doing business as InStockChairs ("InStockChairs," "we," "us," or "our") collects, uses, discloses, and retains personal information when you visit instockchairs.com, communicate with us, request a quote, submit a purchase order, make a purchase, or otherwise interact with our products and services (collectively, the "Services").

This Policy does not apply to information processed solely on behalf of an employer or other organization where a different notice or agreement governs. Some third-party websites, applications, payment methods, or embedded services have their own privacy notices.

2. Important notice about chats

When you choose to use our live chat, the chat may be monitored, recorded, transcribed, and stored by InStockChairs and our live-chat service provider. The record may include your messages, name, email address, IP address, device and browser information, the page you visited, and timestamps. Before the chat begins, we present a notice and ask for your consent. If you do not consent, do not start the chat; you may contact us by email instead. Do not send payment card numbers, Social Security numbers, medical information, or other sensitive information through chat.

3. Personal information we collect

The personal information we collect depends on how you interact with us and may include:

  • Identifiers and contact information, such as name, business name, job title, mailing and delivery address, email address, telephone number, account identifiers, and authentication information.
  • Order and commercial information, such as products viewed, searches, cart contents, orders, requested delivery dates, quote requests, purchase history, returns, warranties, customer-service records, and preferences.
  • Payment and transaction information, such as billing information, payment method, transaction status, and fraud-prevention information. Payment providers generally process full payment-card details; we receive the information needed to complete and document the transaction.
  • Quote, purchase-order, and document information, including product and quantity requests, organization details, contact information, delivery instructions, comments, authorizations, purchase-order files, tax-exemption documents, and other materials you submit.
  • Communications, including contact-form submissions, emails, SMS messages, live-chat messages and transcripts, call recordings or transcripts where enabled and disclosed, attachments, and related metadata.
  • Device, network, and online-activity information, such as IP address, browser and device type, operating system, identifiers stored in cookies or similar technologies, referring URL, pages viewed, search queries, clicks, scrolling, pointer movement, selections, form interactions, timestamps, diagnostics, and session-replay data.
  • Advertising and attribution information, such as campaign source, medium and name, GCLID and similar ad identifiers, conversion events, audience information, and identifiers used to measure ads across sites or devices.
  • Location information, such as approximate location derived from IP address and, if enabled and permitted, more precise location supplied by a browser, device, or form.
  • Inferences and personalization information, such as likely product interests, purchasing intent, preferences, audience membership, and relationships inferred from browsing, transactions, or data received from partners.
  • Reviews and content, such as product reviews, ratings, photographs, survey responses, and any information you choose to make public or submit through a review provider.

Please do not submit sensitive personal information that we have not requested. Free-text fields and uploaded documents may contain information you choose to provide; limit submissions to what is necessary for the request or transaction.

4. Sources of personal information

  • Directly from you, such as when you place an order, complete a form, upload a document, subscribe, call, email, or chat with us.
  • Automatically from your browser or device through cookies, pixels, tags, local storage, scripts, software development kits, session-replay tools, call-tracking technologies, and similar methods.
  • From service providers and partners, including commerce and payment providers, carriers, manufacturers, marketing and advertising platforms, analytics providers, identity and personalization partners, review services, and fraud/security providers.
  • From an employer or other organization on whose behalf you interact with us, and from public or commercially available sources where permitted by law.

5. How we use personal information

  • Provide, process, deliver, and support products and Services, including quotes, purchase orders, payments, shipping, returns, warranties, and customer support.
  • Communicate with you, respond to requests, maintain chat and call records, provide transactional notices, and send marketing communications subject to your choices.
  • Operate, secure, troubleshoot, and improve the site, including fraud prevention, error monitoring, accessibility, search, performance measurement, testing, and service quality.
  • Analyze use of the Services, personalize content and offers, infer product interests, measure campaigns and conversions, and create or use advertising audiences where permitted.
  • Comply with law, enforce agreements, protect rights and safety, respond to legal process, preserve evidence, and establish, exercise, or defend legal claims.
  • Create aggregated or deidentified information and use it for lawful purposes, subject to applicable restrictions on reidentification.

6. Cookies, pixels, session replay, and similar technologies

We and our service providers and partners use cookies, pixels, tags, scripts, local storage, software tools, dynamic telephone-number insertion, and similar technologies. These technologies may operate across pages and over time and may associate activity with a browser, device, email address, telephone number, advertising identifier, or other profile.

You can use the "Cookie Settings" link in the website footer to manage nonessential technologies. Where required, we do not activate a nonessential category until permitted by your choice. You can also use the "Your Privacy Choices" link to opt out of disclosures treated as sale or sharing and processing for targeted advertising. We honor legally required browser-based opt-out preference signals, such as Global Privacy Control, where applicable. Browser settings may also block or delete cookies, but doing so can affect site functionality.

Some technologies, including session replay, can capture how you interact with a page. We configure these tools to mask or exclude sensitive fields and pages, and we do not intend them to collect payment-card numbers, account passwords, or the content of fields we designate as excluded. Please do not enter sensitive information into fields that do not request it.

7. How we disclose personal information

We may disclose personal information to the following categories of recipients for the purposes described above:

  • Analytics, session-replay, testing, search, video, error-monitoring, review, personalization, identity, marketing, and advertising partners.
  • Professional advisers, auditors, insurers, law enforcement, courts, regulators, and other parties where disclosure is required or appropriate to comply with law, protect rights and safety, preserve evidence, or address legal claims.
  • Parties to a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar transaction, including advisers and counterparties subject to appropriate safeguards.
  • Other parties at your direction or with your consent.

Providers may change as our Services evolve. Their processing may also be governed by their own privacy notices.

8. Sale, sharing, and targeted advertising

We do not sell personal information for money. We may disclose identifiers, device and network information, online activity, commercial information, advertising identifiers, and inferences to advertising, analytics, personalization, and identity partners in ways that some state privacy laws define as a "sale," "sharing," or processing for targeted advertising. Depending on where you live, you may opt out using the "Your Privacy Choices" link or a legally recognized opt-out preference signal. We do not knowingly sell or share the personal information of consumers under 16 for targeted advertising.

9. Marketing communications

You may unsubscribe from marketing emails using the link in the message. You may opt out of marketing text messages by replying STOP or following the instructions in the message. We may continue to send nonmarketing communications, such as order, security, support, and privacy-request messages. We retain limited suppression information so that we can honor opt-out requests.

10. Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including to provide Services, complete transactions, maintain business and tax records, honor choices, prevent fraud, secure systems, resolve disputes, enforce agreements, comply with law, and establish, exercise, or defend legal claims. The retention period varies by data type and system. We consider the nature and sensitivity of the information, the purpose of processing, the length of the customer or business relationship, legal and contractual requirements, applicable limitation periods, and whether the information can be aggregated or deidentified.

  • Order, payment, shipping, tax, and accounting records are retained for applicable legal, contractual, audit, and dispute-resolution periods.
  • Quote, purchase-order, support, chat, call, and form records are retained for service delivery and a reasonable period for quality, recordkeeping, disputes, security, and legal claims.
  • Marketing profile data is retained while the relationship or campaign purpose remains active; suppression records may be retained longer to honor opt-outs.
  • Cookie, analytics, advertising, identity, and replay data follows configured vendor retention periods and is deleted or deidentified when no longer reasonably necessary.
  • Uploaded documents and Google-hosted form copies are retained only while needed for the transaction, accounting, dispute, security, or legal purpose and are then deleted or deidentified subject to legal holds.

11. Your privacy rights and choices

Depending on where you live and subject to legal exceptions, you may have the right to:

  • Confirm whether we process your personal information and access it.
  • Correct inaccurate personal information.
  • Delete personal information.
  • Obtain a portable copy of personal information you provided.
  • Opt out of sale or sharing, targeted advertising, or certain profiling.
  • Limit or withdraw consent for sensitive personal information where applicable.
  • Obtain a list of specific third parties to which we disclosed personal information where applicable.
  • Appeal a decision on your privacy request.
  • Receive equal service and pricing and not be discriminated against for exercising privacy rights.

To exercise these rights, use the "Your Privacy Choices" link on our website or email customersvc@modernofficefurniture.com with the subject line "Privacy Request." Describe your request and the state in which you reside. We may ask for information reasonably necessary to verify your identity and authority. We will not require you to create a new account solely to submit a request. An authorized agent may submit a request where permitted by law; we may require proof of authorization and identity verification.

If we deny your request, you may appeal by emailing the same address with the subject line "Privacy Appeal" and explaining why you believe the decision should be reconsidered. We will respond within the period required by applicable law and will provide information about contacting the appropriate regulator when required.

We do not knowingly sell or share personal information of consumers under 16. To exercise California rights or opt out of sale/sharing, use the methods in Section 11. We do not offer a financial incentive or price difference in exchange for personal information unless we provide a separate notice at the time of enrollment.

13. Security

We use administrative, technical, and physical safeguards designed to protect personal information, taking into account its nature and our operations. No method of transmission or storage is completely secure. Please use a unique password where an account is available, avoid sending sensitive information through free-text fields or chat, and notify us if you believe your interaction with us is no longer secure.

14. Children

The Services are intended for business and general consumer purchasing and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact us so that we can review and take appropriate action. We do not knowingly sell or share the personal information of consumers under 16 for targeted advertising.

15. International processing

We and our providers may process personal information in the United States and other countries where privacy laws may differ from those in your location. Where required, we use appropriate safeguards for cross-border transfers.

16. Changes to this Policy

We may update this Policy to reflect changes in our Services, technologies, or legal obligations. We will post the updated version with a new "Last Updated" date and provide additional notice or obtain consent where required for a material change. Prior versions may be requested using the contact information below.
